Swimming & Wading Pools in Child Care

 
Swimming & Wading Pools
at Registered and Certified Family Child Care Homes
 
Wading pools are prohibited by the family child care rules. Although the family child care rules do not specifically mention swimming pools, there are rules that affect them.
 
The Oregon Health Division regulates swimming pools. Any swimming pool at a family child care home that is used for child care is considered a “limited-use public pool” under Health Division rules. All “limited-use public pools” must be licensed by the Health Division. (Oregon Administrative Rules 333-060-0000 to 333-060-0225). Family child care providers may use a pool for child care children only if the pool has been licensed. A provider may have an unlicensed pool at the family child care home that is not used by child care children.  
 
A pool is considered a hazard in all circumstances. Any pools that are present are subject to the following requirements:
  • Direct outdoor supervision is required when a pool is present, regardless of the children’s ages. 
  • A barrier must be in place to prevent children access to the pool. Possible barriers include:
  • Fence with locking gate, around the pool.  Minimum height 4 feet.
  • Rigid, locking pool cover.
  • The pool itself having 4-foot non-climbable sides, with ladder removed and inaccessible.
  • A provider may be required to take additional steps when fencing is absent or insufficient.
 
Additionally, the Office of Child Care suggests that providers have parents sign a written statement that they are aware of the pool’s presence.
